Legislative Decree N.143 issued on June 12, 1959
Rules and authorities of the wheat office
 
 
The president of the Lebanese Republic,
According to the Lebanese Constitution,
According to the law issues on December 12, 1958,
According to the proposal of the minister of National Economy,
And after the approval of the council of ministers,
 
 
Draws the following:
 
 
Article n.1: as amended by law 25/02/1967 (1) the wheat office is named: "Office of Cereals and Sugarbeets" and administration of first class on relation with the minister Of National Economy enjoying special administrative and financial authorities and specified by this law. (Cereal mean: wheat, barley and maize).
 
 
Article n.2: in consideration of the special jurisdictions mentioned in this legislative decree, the functions of the wheat office are subject to the public accountancy rules and the accountancy court and regulation of the governmental employees.
 
 
Article n.3: as amended by law 25/02/1967 (2) objective of the office of Cereal and Sugarbeets.
 
1-    Fixing the supply situations of the bread commodity on basis that ensure safety and good quality.
 
2-    Working on the production of Cereals and sugarbeets and ensuring marketing at subsidized prices without causing harm to the consumer.
Article n.4: as amended by law 25/02/1967 (1) the office of Cereal and Sugarbeets assumes the following responsibilities and the following authorities:
 
1-    Working with different ways and measures on increasing the productivity of Cereals and sugarbeets agriculture.
 
2-    Subjecting import and export of cereals its derivations, its warts and sugar to a previous approval from the council of ministries, based on the conclusion by both the Minister of Economy and the Minister of Agriculture, and according to conditions required by the national production development policy for ensuring the safety and good quality of the provisions.
 
3-    As amended (by law 138/92). Improving a fee and amending it according it according to approval by the council of ministers in order to protect the local production, and supporting it within the max limits indicated below on the following commodities.

4-    Importing wheat for its account according to the needs of provisions following an approval by the council of ministers. The immediate bids related to offers limited by time interval not exceeding three days are not subject to a previous inspection exercised by the accountancy court.
 
5-    Specifying the price for selling the provisions (in stores) for distribution according to an approval by the council of ministers, but other commodities are sold according to a public invitation for bids to be held by a special commission nominated by the Minister of National Economy for whatever value of the deal and should be subject also to the jurisdictions of public Accountancy law in executing its functions.  
 
6-    Working on ensuring warehouses and silos and setting tariff for the various operations undertaken by the silos for the account of others, according to a decree.
 
7-    Import of improved seeds in order to give it to farmers on their account or to be sold or to be exchanged from them or distributed among them at low prices.
 
8-    Working on breeding high quality seeds locally under its supervision, in cooperation with the ministry of agriculture.
 
9-    Subjecting the mechanical mills to conditions for acquiring q minimum amount of wheat permanently in accordance with the council of ministers.
 
10-      Subjecting mechanical mills and bakeries and flour production and bread making to conditions and specifications defined by a decree to ensure public health and high quality.
 
 
 
Article n.5: as amended by law 25/02/1967:
- Office of Cereal and Sugarbeets forms a committee to execute the invitation for immediate traders or bids mentioned in intern 4 of the New Article 4 above.
 
- This committee is headed by the General Director with representatives for ministry of National Economy, Ministry of finance.
 
 
Article n.7: the office of wheat defines two prices for the crop: A Minimum price ensuring selling the farmers crop. The price should be announced before the plantation date in the second half of (August) and a final price defined with second half of (May). This price should not be lower than the minimum price announced at the time of planting.
This price is defined according to the quantity of the crop and the cost of the production.
 
Article n.10: the office of wheat prepares a detailed report in October of each year about its functions during the past year and a detailed plan for its activities for the following year, and presents them to the council of Ministers.
 
 
Article n.11: as amended by law 25/02/1967:
The Returns of the office of Cereal and Sugarbeets consists of:
  • Selling office stocks.
  • Fees imposed by laws.
  • Aids and Donations approved by the Council of Ministers.
  • Services fees.
  • Funds specified in the public budget.
  • Other Returns.
 
 
Article n.12: funds of the wheat office are deposit in the Band defined by the Ministry of Finance and drawn according to a payment bond signed by the Minister, The General Director of the Wheat office, and the head of Accounting Department.
 
 
Article n.13: Committees and common groups from employees of the wheat office and departments of agriculture and National Economy are constituted by a decision from the ministers of Agriculture and National Economy to perform seasonal functions.
 
 
Article n.14: the wheat office does not assume any responsibility due to distributing seeds on account, or due to other aids. The person concerned has no right to claim any indemnity, or exception from paying debts incurred for whatever reason.
